Rubabuddin Sheikh, the brother of gangster and encounter victim Sohrabuddin Sheikh, today alleged before the special CBI court here that one of the accused, a former Gujarat police officer, threatened him.
The trial of cases related to alleged fake encounters of Sohrabuddin and Tulsiram Prajapati by Gujarat police has been shifted to Mumbai.
Sheikh's application said that former sub-inspector of police Naresh Chauhan threatened him today in the court before the proceedings started.
Chauhan's bail should be cancelled and action should be initiated against him, the application said.
Judge B H Loya directed Chauhan to file a reply. The matter is likely to come up for further hearing next month.
Meanwhile BJP president Amit Shah, one of the accused, today filed a fresh application seeking exemption from appearance, saying he was busy with elections in Maharashtra and Haryana. The application was allowed.
CBI has charge-sheeted Shah (who was minister of state for home of Gujarat when the encounters took place) and 37 others including several police officers for two encounters.
According to CBI, Sohrabuddin, who had allegedly links with Pakistan-based terror group Lashkar-e-Taiba, and his wife Kauser Bi were abducted by Gujarat Anti-Terrorism Squad and allegedly killed in fake encounter near Gandhinagar in November, 2005.
Prajapati, an eyewitness to the encounter, was allegedly killed by police in Banaskantha district of Gujarat in December 2006.
