A special court today asked CBI to specify the reasons why it has not chargesheeted a person who was earlier named as an accused in the FIR lodged in connection with coal block allocation scam case.
Special CBI Judge Bharat Parashar, who is exclusively dealing with the coal block allocation cases, told the agency to give details for dropping the name of accused from the charge sheet.
"I am not going into your domain area of investigation. That's none of my business but if you are dropping any name from the charge sheet, then please specify the reasons for doing the same," the judge told CBI's investigating officer (IO) during the hearing of one of the cases.
"Reasons need to be specified clearly why you don't want an individual to be named in charge sheet against whom an FIR was filed. A certain procedure needs to be followed," the court said.
The court observed this while hearing the case in which CBI has chargesheeted Rajya Sabha MP Vijay Darda, his son Devendra Darda, Manoj Jayaswal, Director of Nagpur-based AMR Iron and Steel Pvt Ltd and the firm as accused.
They were chargesheeted for the offences under sections 120-B (criminal conspiracy) read with 420 (cheating) of the IPC and under the Prevention of Corruption Act.
During the hearing, the IO told the court that the agency will file a supplementary charge sheet in the case within a week.
Meanwhile, the court asked IO to remain present before it during the hearings and ensure that documents relating to the case are filed before it in a proper paginated form.
