Spl. Court orders confiscation of engineer's building

The Special Court, Cuttack has directed the police to confiscate a building of one former Superintending Engineer, convicted in a disproportionate assets case.
The Authorised Officer, Special Court, Cuttack yesterday passed the order directing Deputy Commissioner of Police, Cuttack to take over the three-storied building situated on Bajrakabati Road, Cuttack in the name of Gitarani Jena, wife of Gangadhar Jena, the Ex-Superintending Engineer, Irrigation Circle, Baripada.
The special court also ordered the officials to pay the balance amount of Rs 54,858 while taking possession of the property.
Earlier, the Authorized Officer, Special Court, Cuttack, on January 31 had passed an order to surrender the building in the name of Gitarani Jena or to deposit the present market price of the said properties valued at Rs 29,88,308 to state. But the property was not surrendered.
The special court passed the order while disposing the Balasore Vigilance Police Station case of February 19, 2002 under section 13(2) read with 13(1)(e) Prevention of Corruption Act, 1988 registered against Gangadhar Jena, Ex-Superintending Engineer, Irrigation Circle, Baripada for accumulation of property disproportionate to his known source of income.
The Special Court, Cuttack on December 24, 2014 had convicted Gangadhar under section 13(2) of IPC and 13(1)(e) Prevention of Corrpution Act, 1988 for possession of disproportionate assets worth Rs 5,60,039 to his known sources of income which he could not account for.
The court after conviction had sentenced him to three years' imprisonment and a fine of Rs 6,00,000 and another one year of Rigorous Imprisonment for further one year.
