"The advocate appearing on behalf of the applicant (Vipul Aggarwal) sought permission to withdraw the present application. Permission, as prayed for, is granted. The present application is dismissed as withdrawn," a single judge bench of Justice A J Desai observed.
Aggarwal had sought the relief for 45 days to attend to his ailing father. However, the court held that Aggarwal's brothers--a doctor and a businessman--are there to look after their father.
Aggarwal was SP of Banaskantha when Prajapati, believed to be the witness to Sohrabuddin Sheikh's fake encounter, was shot dead near Danta in the district in an allegedly staged encounter by Gujarat police in December 2006.
