Unauthorised constructions perennial problem: Delhi Lokayukta

Holding that unauthorised constructions in the city have become a "perennial problem", Lokayukta Justice Manmohan Sarin today sought "systemic changes" coupled with political will to effectively deal with the challenge.
Delivering a judgement in a case of alleged unauthorised construction in Rohini area in North West Delhi, he said carrying out unauthorised constructions should be prohibited and made commercially unviable.
"The systemic changes or improvement in procedures need to be reinforced by a determined political and executive will to eliminate unauthorised constructions," he said.
Expressing serious concern over widespread unauthorised constructions in the city, he said though the Supreme Court and the Delhi High Court had taken steps to deal with the problem, the measures had a "limited purpose".
"These were timely measures and suited to address the infractions then noticed. They had a limited purpose which has been served. However, such measures are temporary in nature and outlive their utility, with passage of time," he said.
The comments by Justice Sarin came in a case of alleged unauthorised constructions being carried out in sectors-11, 16 and 17 in Rohini, Delhi. The complainants had alleged involvement of councillor Pravesh Wahi and MLA Kulwant Rana in such unauthorised constructions.
In the order, the Lokayukta said no direct evidence regarding involvement of Wahi and Rana in these unauthorised constructions was established.
The Lokayukta, however, recommended to Lt Governor Najeeb Jung to consider directing the North Delhi Municipal Commissioner to institute a departmental inquiry against concerned officers for not preventing the unauthorised construction or proceeding against them at the initial stages itself.
In his order, Justice Sarin said a significant question arose for consideration regarding the role and obligation of the municipal councillor when large-scale unauthorised constructions take place in his area.
The Lokayukta also directed the municipal corporation to enforce provisions of bye-laws to ensure that there is no violation of the same in the area.
Justice Sarin asked municipal corporation to set up a committee comprising the municipal councillor and deputy commissioner of the zone to monitor and review actions being taken by the officials concerned against unauthorised constructions.
