Malhotra Case Shifted To Mumbai Hc

The Supreme Court yesterday directed the transfer of two cases, pending in the Calcutta high court and the Thane district court in Maharashtra, over the trade mark dispute in the Malhotra family, to the Bombay High Court.

The trade marks of shaving blades involved in the litigation are, Topaz, Panama, Prince and Ashok.

The company had claimed that the trade markes originally belonged to the Malhotra International.

Later, the Malhotra brothers fell out led to litigations at several levels over the years. Malhotra International and Vidyut Metallics had signed an agreement by which the latter could use the trade marks, subject to termination after notice of three months.

The company terminated the agreement, against which Vidyut moved the Thane district court. And the court approved the termination.

On appeal, the Bombay high court did not grant any interim relief to Vidyut Metallics.
