A Delhi court on Wednesday sought a response from the CBI on a plea filed by former Bihar chief minister Rabri Devi seeking transfer of the IRCTC hotel scam case to a different judge. Principal and Sessions Judge Dinesh Bhatt was hearing the plea of the Rashtriya Janata Dal (RJD) leader and issued the notice to the Central Bureau of Investigation (CBI). The court, however, refused to stay the ongoing trial proceedings in the CBI case. Earlier on Monday, she moved a plea seeking transfer of the CBI and ED cases registered against her to another court, saying she had a reasonable apprehension that fair and impartial justice would not be rendered. Special Judge Vishal Gogne framed common charges of criminal conspiracy and cheating against Rabri Devi and Tejashwi Yadav in the case, which stems from alleged irregularities in the grant of operational contracts of two Indian Railway Catering and Tourism Corporation (IRCTC) hotels to a private firm. On May 29, the court reserved its order after the arguments were concluded on the aspect of charge. Prasad, Devi and Yadav have refuted corruption and other charges levelled against them by the Central Bureau of Investigation (CBI) in the case. The charges also include criminal conspiracy and cheating, and carry a maximum jail term of seven years. The three claimed before the court through their lawyer that the CBI lacked evidence to prosecute them. Prasad, who was the railway minister during the UPA-I government, earlier questioned the validity of sanctions obtained by the CBI to prosecute him. A Delhi court on Tuesday refused to cancel the bail granted to Bihar Deputy Chief Minister Tejashwi Yadav on a plea by the CBI in the IRCTC scam, saying it did not find any specific ground to order cancellation of the relief. Special Judge Geetanjali Goel, while declining the CBI's petition, asked the young RJD leader to be careful with words and use them appropriately. In its petition, the CBI had claimed Yadav, at a recent press conference, attempted to subvert the process of law and thwart the entire investigation as well as the consequent trial, and blatantly abused the liberty granted to him. It alleged Yadav issued "direct threat" to CBI officers and their families and "indirect threat" to witnesses. The central probe agency accused Yadav of having attempted to "portray the CBI in bad light and under the influence of political parties" by using innuendoes such as "Jamai" (son-in- law) of a political party. Granting time to Yadav's counsel to file response, Special Judge (CBI) Geetanjali Goel directed personal appearance of the RJD leader on October 18. Earlier on September 17, the court had issued a notice to Yadav on the application moved by the probe agency and sought his reply. The CBI on Saturday moved a court here seeking cancellation of bail granted to Bihar Deputy Chief Minister Tejashwi Yadav in the Indian Railway Catering and Tourism Corporation (IRCTC) scam. Special Judge Geetanjali Goel issued a notice to Yadav on the application moved by the probe agency and sought his reply by September 28.
