HC tells site not to use naukri.com content

The Delhi High Court has restrained Bixee.com from deeplinking, copying, downloading and reproducing the contents of naukri.com.
 
The court observed that naukri.com was able to show that they had been running a website and had developed a dynamic data base of jobs available primarily in India.
 
"Because of the large number of hits that this website receives, the plaintiff is able to generate revenues on account of the advertisements that are available on the website," it said.
 
The petitioner had contended that Bixee.com had set up a website which enabled the users to search for jobs on various websites such as naukri.com by providing hyper links. While this led the users directly to the jobs they wished to view, it in the process completely bypassed the home page of the jobsites.
 
The court said, "The necessity to access naukri.com website would be obviated, thereby resulting in great financial loss to it, as the plaintiff had spent a lot of time, money and energy in developing the database."
 
Naukri.com counsels Upamanyu Hazarika and Prathibha Singh had argued that the defendant was copying the entire database through deeplinking whereby certain software programmes accessed the plaintiff's servers and downloaded portions of its updated database.
 
Naukri.com's policy prohibited deeplinking into the website without its consent, they had contended.
