Kelly Rutherford summoned to court with kids

Kelly Rutherford might have made a bold move by not sending her children back to Monaco despite of court orders but the actress is now facing the consequences of her act.

Tabloid media revealed that a New York Supreme Court judge has signed a writ of habeas corpus filed by the 46-year-old actress' former husband Daniel Giersch according to which she must appear in court with her kids Hermes and Helena on August 11, reported People Magazine.

Giving details about the orders, Michael Stutman, head of the family group at Mishcon de Reya New York said that "te writ of habeas corpus" was a quick way to get the U.S. court to recognise the Monaco court order and to enforce it, and his guess was that Giersch's papers in support of his petition were very compelling.

Odds were that the kids were going back to Monaco, he added.

The 'Gossip Girl' star, who bought her kids to United States for summer vacations, has been in a bitter custody battle with her former husband since she filed for divorce in 2008.
