Affleck to be monitored in custody agreement with Garner

Actors Jennifer Garner and Ben Affleck have reached a custody agreement for their three children, but the latter who has dealt with problems of alcohol addiction, will be monitored during physical custody of the little ones.

According to tmz.com, the custody agreement has two elements -- legal and physical custody.

While legal custody is simple as they will jointly agree on decisions that affect the children, such as education and various activities, it is physical custody which is tricky.

Their agreement on physical custody doesn't outline any specific division of time with the children. But tmz.com reports that Garner will get the lion's share of custodial time, and when Affleck has time with the children, he will have a monitor to ensure he is sober and the children are safe.

Together, they have children who are aged 12, 9 and 6.

Affleck is now out of rehab after voluntarily checking himself in for treatment in late August.
