Gang-rape: Court seeks medical report of accused

A Delhi court hearing the Dec 16, 2012 gang-rape Monday sought the medical report of an accused admitted to hospital with high fever, while the victim's friend deposed against two accused involved in the assault in a moving bus.

Additional Sessions Judge Yogesh Khanna called for the medical report of Vinay Sharma from Deen Dayal Upadhyay Hospital where he was taken May 6 from Tihar Jail following high fever.

Sharma's counsel also sought interim bail for his client, saying he be shifted to another hospital for better treatment.

The accused fell sick while in judicial custody, said the lawyer.

The victim's male friend told the court that accused Mukesh and Vinay Sharma were in the bus when the incident took place.

The complainant and eye-witness in the case, a 28-year-old software engineer, refuted the contentions of accused Mukesh and Sharma, saying he had, on an earlier occasion, identified the bus and even the accused who were present in it that night.

During the hearing, Mukesh's counsel contended that his client was not involved in the gangrape and had neither beaten the youth nor robbed the victims.

Sharma's counsel claimed that client was not in the bus at the time of the incident and was at a music function in south Delhi.

The 23-year-old woman was brutally tortured and gang-raped in the bus by five men and a juvenile. She later died in a Singapore hospital.

The juvenile is facing proceedings before a Juvenile Justice Board, while the four other accused were put up for trial in the fast track court. One of the accused allegedly committed suicide in jail.
