The Delhi High Court Friday ordered a deputy commissioner of police to examine a case in which the Chandigarh police forcibly took into custody a man, declared an absconder and booked as an accused in 32 criminal cases.
A division bench of Justice Sanjiv Khanna and Justice G.P. Mittal directed DCP, west Delhi, to examine the facts of the case and said: "In case, there is violation of law, appropriate action as warranted and required under law will be taken against any person involved."
The court order came while hearing a plea filed by a woman who alleged that about 10-12 men entered her house April 30 and forcibly took away her husband Deepak Khanna after placing a pistol to his head.
Later, on the court's direction, Delhi Police initiated an inquiry and found that policemen had taken Khanna in connection with a theft case.
The Delhi Police had produced Khanna before the court here May 15 and he was released on the court's order.
According to Delhi Police, Khanna is involved in about 32 cases, most of which are related to theft of vehicles.
In some cases, he was declared a proclaimed offender while in a few, he was either discharged or acquitted. In one case, the matter was compromised.
"There are three cases pending trial, but till now, he has not been convicted in any case. This is one aspect of the matter," police said.
The woman alleged she received a ransom call demanding Rs.10 lakh from the Chandigarh police.
The Delhi Police have informed the court a case has been registered here in Rajouri Garden against five Chandigarh policemen June 11 under various charges dealing with kidnapping with intent to secretly and wrongfully confine a person, putting a person in fear of injury in order to commit extortion and common intention.
