7-yr jail to man in attempt to murder and robbery case

A youth has been sent to seven years in jail by a Delhi court on charges of attempt to murder a man in a failed robbery attempt on the sidelines of a wedding reception in Northwest Delhi two years ago.
Additional Sessions Judge Pankaj Gupta convicted Shakurpur-resident Shashi alias Sachin for the offences under sections 398 (attempt to commit robbery), 394 (causing hurt in committing robbery) and 307 (attempt to murder) of the IPC and also imposed a fine of Rs 25,000 upon him.
"The aggravating circumstances are that the convict committed the offence during night at a public place. The said acts of the convict are detrimental to the peace of the society," the court said.
The court also held that merely because it was mentioned in the medical certificate that the injury was simple, it is not sufficient to "dilute the act" of the accused as it was inflicted on the left side of the chest near the heart.
"Therefore, merely because in the said MLC (Medico Legal Certificate), it was mentioned that the injury was simple, is not sufficient to dilute the act of the accused," it said.
According to the FIR, Jayant Chatterjee was clicking photographs of his sister and brother-in-law at a wedding reception in Pitampura on December 8, 2014, when Shashi came from behind and tried to snatch his mobile. When Chatterjee resisted the snatching, Shashi pulled out a knife and slashed him.
When the Chatterjee's brother-in-law Rajiv Bhasin came to his rescue, the accused inflicted a knife wound on the left side of Bhasin's chest, the FIR said, adding that Shashi was overpowered by the crowd gathered there and handed over to the police.
During trial, Shashi denied all incriminating evidence and claimed innocence saying he was falsely implicated in the case.
