The appeal was filed by senior Advocate Y V Giri on behalf of Secretary of Legislative Assembly Hareram Mukhiya.
A single bench of Justice Jyoti Sharan had on January 6 set aside the termination of four rebel JD(U) MLAs Gyanendra Singh Gyanu, Rahul Sharma, Neeraj Kumar Bablu, Ravindra Rai by Speaker Uday Narayan Chaudhary on November 1 last year for alleged anti-pary activities including cross-voting in the bypoll for two Rajya Sabha seats in middle of last year.
The four MLAs-- Ajit Kumar (Kanti), Raju Kumar Singh (Sahebganj), Suresh Chanchal (Sakra) and Poonam Devi (Digha)-- were disqualified by Uday Narayan Chaudhary on December 27 under anti-defection law.
Giri told PTI that in the appeal it has been urged that the matter should be seen properly in the light of 10th schedule of the Constitution and earlier ruling of the Supreme Court in similar instances.
