This was stated by GCMMF chairman Vipul Chaudhary's counsel P S Champaneri as arguments in the case relating to the no-confidence motion moved against him opened in the High Court.
However, counsel for GCMMF and its member unions, who moved no-confidence motions, told Justice A J Desai that the petition was maintainable, adding that a meeting could be held to consider the no-confidence motion.
On October 25, the Gujarat High Court had stayed the GCMMF's board meeting scheduled for October 26 to discuss the no-confidence motion against Chaudhary.
Chaudhary had filed a petition after the no-confidence motion for alleged mismanagement was moved against him by 14 out of 17 directors of GCMMF district dairy co-operative unions.
The no-confidence motion was expected to be taken up at the board meeting.
However, the court stayed the board meeting on the ground of absence of provision for moving a no-confidence motion under the Gujarat Co-operative Societies Act and the stay was extended till November 19.
