According to legal documents, the Coldplay frontman has failed to respond to Gwyneth's separation papers which could lead to her being eligible for a default judgement, meaning the 43-year-old actress would be granted what she has asked for in her petition with Martin, 38, having no right to a counter claim, reported TMZ.
It is known her petition asks for joint custody of their two children, daughter Apple, 11, and nine-year-old son Moses.
Paltrow filed for divorce in April 2015, and Martin was served with the legal documents in May 2015, with the case remaining dormant since then.
