The officer has filed the petition seeking justice against the Army's "alleged biased attitude in shielding" a Colonel, presently posted at 4 Division Headquarters at Allahabad, the officer's lawyer Rajiv Manglik said here today.
"In the petition, the officer has alleged that he had lodged a complaint with the Army that the accused Colonel committed an offence of 'adultery' when the officer was posted in field area and his wife was staying in Noida and Delhi away from her husband," he said.
He said the officer is allegedly being promoted to the rank of Brigadier whereas for such offences under the Army Act, officers normally face General Court Martial.
Manglik said his client has contended before the Tribunal that not taking timely action against the accused shall affect the morale of the Army and leave a question mark in the mind of soldiers defending the borders as to whether their families are safe when they are performing national duties.
