Metropolitan Magistrate Ambika Singh asked the officials of Civil Lines Police Station in central Delhi to file the report on September 3.
"Let the status report be called from the police station concerned for September 9," the court said.
The court's order came on a complaint filed by advocate and RTI activist Vivek Garg, who alleged that an offence was committed by the MLA as he managed to reimburse his mother's medical allowance running into lakhs of rupees from the Delhi government, despite the fact that his parents were not dependent on him and not entitled for medical reimbursement.
He sought that an FIR be registered against Tripathi, who is MLA from Model Town constituency here, for alleged offences of cheating, criminal breach of trust by public servant, forgery for cheating and criminal conspiracy under the IPC.
The complaint claimed that Tripathi has obtained a medical facility card under the Delhi Government Employees Health Scheme from Government of NCT of Delhi and to obtain "wrongful gains", he has disclosed in the card that his parents are dependent on him.
It said as per the information received through RTI in March and April, the MLA has reimbursed medical payments from the government for his parents to the tune of over 5.5 lakh.
"Despite knowing the fact about his crime and MLA (accused) claims himself a post graduate studied in MA Ancient History, he unlawfully with mala fide intention, managed to reimburse the medical allowance/ claim from Government of NCT of Delhi, which is quite serious offence, in the eyes of law. Being a public servant, elected by the voters, the crimes of the accused become more serious," the complaint alleged.
