Five people convicted for attempting to murder a policeman following an argument have been sentenced to five years jail term by a Delhi court which said there was nothing on record to show that the victim wanted to falsely implicate them.
Additional Sessions Judge Virender Kumar Bansal awarded the jail term to the five convicts -- Ajay, Sumit, Sunil Paswan, Vineet and Mangal Singh -- who had assaulted the policeman and caused him grievous knife and stick injuries.
"Keeping in view submissions and facts of the case that accused persons badly thrashed the victim (Ajay) causing grievous injuries on his person and also the fact that they all are of young age, therefore, they are sentenced to five year rigorous imprisonment with fine of Rs 1,000 each," the court said.
The court said there was nothing on record to show why the victim will falsely implicate the convicts.
"There is nothing on record that he had any axe to grind against them or to falsely implicate them. The witness (victim) has stood through the test of cross-examination and there is no reason to disbelieve his testimony.
"The injuries as proved on record are grievous and are on vital part of the body. All the accused persons on the saying of Sunil Paswan (convict) assaulted him (policeman) that also with the intention to kill him because they only left him after he fell down on the ground," the court said.
According to the police, some construction work was going on in the shop of the policeman's father and an argument broke out with a mason which was then settled.
Later, the mason, along with the convicts and others, came to the shop armed with a knife and sticks. Sunil exhorted "he was policeman Ajay and he should not be spared" and they all attacked the victim with a knife and sticks, the police had said.
The policeman was repeatedly stabbed and beaten up by the convicts and he fell down after which they fled, the police had said, adding that he was taken to a hospital.
The prosecution said the victim had received 12 injuries and that the convicts had attacked the cop knowing fully well that he was a police official.
During the trial, the five men had denied the entire evidence against them and claimed that they were falsely implicated.
