The bench of justices P V Hardas and G S Kulkarni was hearing a PIL seeking a CBI probe into the alleged suicide of Kapil Patil.
While the police alleged that the victim committed suicide after escaping from their custody, the PIL, filed by activisit Ketan Tirodkar, demanded that the probe should go into the circumstances in which he died.
Afterwards, Patil was picked up by police and charged in a false case, before getting bail, according to the PIL.
However, he was picked up again, and on March 21, 2010, his body was found on a railway track, it said.
Patil had no criminal antecedents and hailed from a well- educated family, with his father being a bank employee, according to Tirodkar.
The state government had ordered a CID inquiry, but it did not yield any result, the PIL said and prayed for a CBI probe.
