HC direction to Chennai Corpn Commissioner

The Madras High Court has directed the Commissioner, Corporation of Chennai, to file an affidavit within a period of two weeks after scrutiny of records within two weeks on a contempt petition.
The petition was filed by R. Vadivelu and D Gopalakrishan of Neelankarai area, residing behind the plot of one Devaraji.
They alleged that the man after getting a 'de-sealing' order from the court for demolishing an unauthorised construction, was continuing with the construction.
Taking serious view of the attitude of Devaraji, the court directed the then Executive Engineer (Enforcement) who was holding the post when the unauthorized construction was going on to be present in court on September 14.
It also directed Devaraji to be present in court on that date. The bench also impleaded the tenant who came into the property as respondent and directed him to be present besides posting the matter for further hearing on September 14.
The First Bench, comprising Chief Justice Sanjay Kishan Kaul and Justice T.S. Sivagnanam, said:"We have not yet issued notice of contempt to the Commissioner of Corporation of Chennai, but we call upon the commissioner to look into the matter and file an affidavit on the basis of the scrutiny of the records within two weeks."
The matter relates to the construction made by one Devaraji's within his premises which was sealed and locked and he had approached the court to unlock an unseal his premises enabling him to carry out the demolition of the unauthorized, deviated portion.
The court had directed the Corporation Commissioner and the Executive Engineer (Enforcement) Zone XV, Corporation of Chennai to unlock and unseal the premises to enable Devaraji to demolish the deviated portion of the construction.
The petitioners alleged that instead of demolishing the deviated portion,Devaraji proceeded with the construction contrary to the order of the Court.
The petitioners said Devaraji and authorities concerned had willfully acted against the court order.
