The Madras High Court today directed the Commissioner and Director of Most Backward and De-notified Communities Welfare and Joint Director of Kallar Reclamation, Madurai, to appear in person on June 23 in a contempt case.
Justice N Kirubakaran on a petition by K Thirupathi, a school teacher of Government Kallar Higher Secondary School, Anaipatti, Dindigul District, criticised the officials Ashok Dongre and N Latha for not obeying the September 10, 2013 order of the High Court to implement the Government Order (GO) dated 02.03.2011 for giving appropriate posting to the petitioner within a 12 weeks from the date of receipt of the order.
Thirupathi who was appointed as a teacher on July 25, 2006 completed his probation on July 24, 2008. He belonged to Hindu Valluvan Community coming under Scheduled Caste.
He applied for transfer from the Kallar Higher Secondary School on February 14, 2011. The Secretary, School Education Department issued a GO on March 2, 2011 agreeing to transfer the teachers to Government Schools working under the control of Director of School Education, Chennai in the same academic year.
As it was not implemented, the petitioner approached the High Court for a direction to authorities for its implementation, on which the Court in its on September 10,2013 directed the authorities to implement the GO within 12 weeks on receipt of the order.
But the authorities did not implement Court order following which Tirupathi filed a contempt petition.
However, when the petition is pending before the High Court the Director of School Education Department passed transfer order to the petitioner to Government Higher Secondary School, Pudatikottai, Krishnagiri District.
But the Secretary, School Education Department on May 23 this year issued an order directing the Head Master of the School where the petitioner is working not to relieve him until a reliever is posted.
The etitioner moved the Court pleading to punish the concerned authorities for violating the Court Order.
Justice Kirubakaran directing the authorities to be present in the Court said "prima facie, it appears that the respondents wanted to give a false picture that the order of this Court was complied with and thereafter, an attempt has been made to frustrate the order passed by the court by issuance of another order by the in charge officer of the Joint Director of Kallar Reclamation, Madurai making not to relieve the petitioner.
