If there was prima facie case in the complaint, then they should register a case and take action as per law, Justice M.M.Sundresh of the Madurai Bench said.
The petitioner, Marirajan, of Oddapidaram in Tuticorin district, an ex-serviceman, said he used to visit his relatives at Sattur in Virudhunagar district frequently.
He said police filed two false cases against him on January 13 and January 16 last year charging that he sold spurious liquor. When he came out on bail, they filed another case on June 20 on the same charge.
The Madras High court bench cancelled the detention orders when he pointed out that the cases filed against him were false.
At this juncture, VAO Sesuraj and Srivilliputhur PEW SI Surendrakumar prepared another "fake" Goondas Act order and pasted it on the door of Mariajan's house at Puliangudi, he alleged.
When Mariajan sought to know the details of the Goondas Act detention order under Right to Information Act, he was told that no such order had been issued.
