Justice Sadhana Jadhav yesterday granted Nigam interim anticipatory bail to Nigam, an expert in stem cell hair transplant, and directed the police to file their reply to the bail plea.
Nigam had approached High Court after his anticipatory bail application was rejected by the sessions court.
Nigam's counsel Mahesh Jethmalani argued that the cheating case was filed due to professional rivalry.
Shere, also a hair specialist, had last year filed cheating complaint with the Versova police alleging that Nigam had poached her clients and their photographs to further his business. An FIR was registered under sections 406, 420, 506, 507, 509 r/w 34 of the IPC and 33(2), 36 (2) of the Maharashtra Medical Practitioners Act.
However, Jethmalani argued that it was Shere who had poached Nigam's clients. According to Nigam, he had asked Shere to join his clinic. Although she accepted, she never joined and started giving advertisements identical to that of Nigam.
