Islamabad High Court's (IHC) judge Justice Shaukat Aziz Siddiqi refused to hear the petition and instead sent it to the Chief Justice Anwar Kasi.
Siddiqi stated that he cannot take the case as IHC has already given a decision regarding the removal of the former PCB chairman before.
A two member divisional bench of the IHC had reinstated Zaka Ashraf as PCB chairman last month but just 27 days later he was removed again from the post by the government which has now appointed a managing committee to run cricket affairs in the country for a period of four months.
Interestingly on July 19, 2013, Justice Siddiqui had declared the election of Zaka Ashraf as chairman illegal and had issued directives to Sethi who was then acting chairman to hold elections within 90 days.
Ashraf, 60, had been PCB chairman since October 2011.
On May 8, 2013 Ashraf had become the elected head of the PCB after winning a four-year term under a new constitution approved last year.
The government while removing Ashraf on Monday has accused him of mismanagement and misuse of power and a member of the managing committee, Shakil Shaikh has claimed they would be issuing a white paper on Ashraf's actions soon.
