Justice Ram Vijay Singh issued the notice on a plea by Rajendra Kumar.
Kumar claimed that BJP had first nominated him as its candidate from the constituency but later, without cancelling his candidature, named Singh.
In the petition, he has alleged that first he was granted the election symbol, but subsequently it was issued (under Form A&B) to Singh, without cancelling his candidature.
Kumar claimed that his nomination as the BJP candidate was wrongly rejected by the returning officer on the ground that the party had subsequently given ticket to Singh.
Fixing September 8 as the next of hearing, the court asked Singh to reply by this date.
