HC rejects plea to quash notification of constable recruitment

The Madras High Court today dismissed a plea seeking quashing of a notification on recruitment of constables in Tamil Nadu over upper age limit cut-off date, saying it cannot interfere in such policy matters.
Justice S S Sundar dismissed a batch of petitions filed by aspirants, who contended that the notification by the Tamil Nadu Uniformed Services Recruitment Board was "arbitrary and illegal" in respect of fixing the cut-off date for the maximum age limit beyond the last date of submission of applications.
The petitioners submitted that the cut-off date for upper age limit had been fixed at July 1, 2017 though the last date for submission of application was February 22 last.
The rule restricted participation of several candidates who were eligible to apply as on February 22, they said.
The government counsel said the court could not interfere in such policy matters, and age limit was fixed as per statutory rules.
The judge in his order said: "It is a well-settled principle and law that court should observe restraint and should not interfere merely because some persons were inconvenienced."
He further observed that the age limit had been fixed as per service condition rules. "They are statutory rules and the court could not interfere in such policy matters of the government," the judge added.
