The Lucknow bench of the Allahabad High Court has sought a reply and details of investigation from the police on a writ petition seeking a CBI inquiry into the FIR registered against Mining minister Gayatri Prasad Prajapati, State Women Commission Chairman Zarina Usmani and others at police station Gomtinagar.
Social activist Nutan Thakur alleged in her FIR that Prajapati, Usmani and another person, by way of criminal conspiracy, had framed up a rape case against her husband Amitabh Thakur, an IPS officer, by a Ghaziabad woman in Gomtinagar police station here.
A division bench of Justice Ajai Lamba and Justice Ravindra Nath Mishra-II, passed the order yesterday on a petition filed by social activist Nutan Thakur seeking a CBI inquiry into the matter saying she did not expect fair investigation by the police agencies of Uttar Pradesh.
The petitioner had registered the case under section 467 (forgery of valuable security),468 (forgery for cheating), 471 (using as genuine a forged document), 420 (cheating), 203 (giving false information on offence committed) and 12 of IPC.
The petitioner claimed that firstly her FIR was not registered despite her presenting it before the police and then after lodging it the Final Report(FR) was filed within 3 days without recording relevant references and no reasons for concluding so were presented.
She further said that dissatisfied with the FR, she moved an application before the CJM Lucknow. The CJM's court directed the police for further investigation into the matter but it is pending for the last four months.
"The investigating officer is directed to file parawise affidavit while also detailing the investigation conducted till date," the HC said and posted the matter for July 7.
