HC stays proceedings before Chief Metropolitan Court

The Madras High Court today stayed all further proceedings on the file of Chief Metropolitan Magistrate Court at Egmore, initiated against actors K.Dhanush and Ishwarya Rajesh, with regard to Tamil film 'Kakka Muttai.'
Justice P.N.Prakash, before whom the criminal original petition filed by the actors and director M Manikandan besides producer Vetrimaaran came up for hearing, admitted the plea and stayed further proceedings by the CMM Court.
One Manivannan had lodged a private complaint of criminal defamation before the CMC alleging an actor depicting herself as an old woman had made some derogatory remarks against a advocate-character.
Dhanush and others filed the criminal original petition against this stating that the film was certified for public exhibition after examination by the members of examining committee. They further submitted that there was no harmful imputation as alleged by the complainant and it was also not a specific one and it is a generic word used in the script.
They sought to quash the complaint since "it does not have prima face case and all "allegations have been made only with an ulterior motive to make illegal gain" out of such complaint.
They said the dialogue along with the visual would explicitly speak about the character in the movie and "there is no imputation to harm or defame any one as alleged by the complainant."
The petitioners said the complainant cannot use the criminal complaint as an instrument to harass them and thus it is liable to be quashed and prayed to stay all further proceedings before the CMM Court.
