IAS officers' body seeks intervention in Bihar cops' 'conduct'

The Central IAS officers' association has sought immediate intervention of the Bihar and the Union governments into the alleged "arbitary functioning" of the police against officers posted in the state.
The Central IAS officers' association, which represents 4,926 officials working across the country, also supported the demand of its Bihar unit for a probe by an independent agency like the CBI in cases involving two civil servants.
In a statement, the central association of IAS officers' asked both, the state as well as the central government, to ensure that hardworking, honest and sincere civil servants are not demoralised by arbitrary and malafide actions of the police machinery in Bihar.

The central IAS officers' association, representing the prestigious administrative service officers, sought immediate help of the Centre to check alleged arbitrariness by the Bihar Police in acting against civil servants.
The move comes following alleged wrongful arrest of two officers-- Jitendra Gupta and Sudhir Kumar-- of Indian Administrative Service (IAS) working under Bihar government.
The central association after perusing all the facts placed before it by its Bihar unit has decided to support both the resolutions which includes safety and security for its officers as well as a probe by an independent agency.

When contacted Sanjay Bhoosreddy, Secretary of the central IAS association, said there is a need to check arbitrary behaviour of some of the policemen working in the Bihar Police.

"It appears that the police is acting arbitrarily there and they need to follow the rule of the law," he told PTI.
"We want there should be a thorough probe in the cases involving the two IAS officers by an independent agency," Bhoosreddy, a senior IAS officer, said.
Briefing about the cases, the association claimed that the Bihar Police had acted in a malafide manner against Gupta, a young IAS officer, while serving as Sub-Divisional Magistrate Mohania.
"Jitendra Gupta was falsely implicated in a vigilance case. At that point of time also the police had violated the statutory provisions of Criminal Law, which was brought to the notice of the authorities.

The alleged vindictiveness of the Vigiliance unit did not
stop here and the state government moved the Supreme Court against the order.
The country's highest court also did not find an merit in the case and dismissed the appeal at the admission stage itself, it said.
Without learning from their past experience, whereby both the Patna High Court and the Supreme Court deprecated the police for their ingeniousness in fabricating false cases with ulterior motives and in a mala fide manner, the police this time arrested Sudhir Kumar, Chairman, Bihar Staff Selection Commission from Hazaribagh on the night of February 23, it alleged.

The arrest was shown on record to have been made from Patna at around 11 AM in the morning of February 24 despite Kumar fully cooperating with the investigating agencies, the statement said.
"He was neither absconding nor was found tampering with evidence, if any. Therefore, there was no need to arrest him without following the procedure and precautions of arrest as provided in Section 41 of the Criminal Procedure Code.
"Therefore, the IAS officers' association of Bihar has demanded independent inquiry, equity, justice and fair play, that the case forthwith be transferred to the CBI," the officers' body said.

Kumar has been arrested in connection with a paper leak scam related to clerical-grade recruitment examination.
The CBI will be in a better position to independently establish the truth, as repeated reports have suggested interference and/or patronage of persons with clout, the central IAS officers association said.
