In his petition before Judicial First Class Magistrate K P Anil Kumar, he said Modi had described Antony and AAP founder leader Arvind Kejriwal as 'Pakistani agents' at an election rally in Jammu and Kashmir on March 26, 'deliberately imputing and implicating' them.
Hence, it was proper and fit to initiate prosecution proceedings against Modi under IPC Sec 504 (insult intended to provoke breach of peace), 505 (false statement, rumor etc circulated with an intent to cause mutiny or offence against public peace) and Sec 66 A (b)(c) of Right to Information Act, 2005, he said.
The magistrate after perusing the petition, posted the case to April 16 for recording the petitioner's statement.
On March 26, Modi had targeted both Antony and Kejriwal, calling them "agents of Pakistan and enemy of India" and speaking its language.
"Three AKs have emerged as a unique strength for Pakistan. One is AK-47 which has been used to cause bloodshed in Kashmir. The second is A K Antony, who informs Parliament that people wearing the dress of Pak army beheaded our soldiers while our Army says Pakistanis had come. Who do you want to benefit with your statement," he had asked.
