MACT awards over Rs 10 lakh to parents of man mowed down in a road accident

A motor accident claims tribunal (MACT) has awarded over Rs 10 lakh to the parents of a man who was mowed down by a truck in Haryana in 2012.

MACT presiding officer Paramjit Singh asked Shriram General Insurance Company Ltd, insurer of the offending vehicle, to pay a total of Rs 10,92,000 as compensation to the parents of Haryana resident Anil Mann.

"The existence of the permit and fitness of the offending vehicle at the time of accident has not been proved on record in accordance with law and in absence thereof, the Shriram General Insurance Company Ltd shall be entitled to recover the compensation amount from the driver and the owner of the offending vehicle, in accordance with law," the tribunal said.

The tribunal awarded Rs 10,61,424 towards loss of dependency, Rs 15,000 towards loss of estate and Rs 15,000 for funeral expenses incurred by the parents.

It also awarded the petitioners an interest of nine per cent per annum on the total compensation amount from the date of filing petition in August 2012 to the date of realisation.

The compensation was awarded to Rajbir and Krishna, parents of Mann, who was hit by a truck on July 13, 2012 while crossing a road after which he was admitted to a local hospital, where he succumbed to his injuries.

The court noted that the truck was driven in a rash and negligent manner where it first hit Mann and then subsequently collided with two buses of Rajasthan and Haryana roadways before hitting him again.

The court also noted that Mann was the sole earning member of his family and is survived by his old parents aged 60 and 45 years.
