A Delhi court has acquitted a man of the charges of abducting a girl, noting that she had gone with him willingly but her parents had falsely implicated him as they were against their marriage.
Additional Sessions Judge Rajneesh Kumar Gupta let off the man, a Ghaziabad resident, saying there was nothing to prove that he had forced the alleged victim, who claimed that she was in love with him and wanted to marry him, to accompany him.
"From the testimony of prosecution witness 2 (girl), no evidence has come on record to prove that it is the accused who had forced or enticed her to go with him and done any such act by which he had influenced her decision to go with him," the judge said.
According to the prosecution, the parents of the girl had lodged her missing complaint on May 20, 2014.
A few weeks later, the police found the girl with the accused and arrested him for the charge of kidnapping her in order to compel her to marry him.
The accused was charged for the offences of kidnapping (section 363) and abducting woman to compel her for marriage (section 366) under the IPC.
The accused had denied the allegations and claimed that he was falsely implicated in the case.
