A man, who along with his aide had abducted and sexually assaulted a woman, has been sent to six years in jail by a Delhi court, which said they were "roaming like hungry wolves" in search of a prey to satisfy their sexual lust.
The court refused to show any leniency to convict Kailash Singh, a resident of Bijwasan in south west Delhi, saying he does not have any respect for the dignity of women. His associate Jairam has been absconding since then.
"The crime committed by the convict cannot be said to be jejune (insignificant). It seems that he along with his associate were roaming like hungry wolves, in the look out of a prey to satisfy their sexual lust and as soon as they found the prosecutrix sitting alone in an isolated area, their eyes shown bright and took her forcibly to the tenanted room of the convict," Additional Sessions Judge Virender Bhat said.
The judge also pulled up the investigating officer (IO) for committing grave lapses and said "I am constrained to note here that the investigation in the case has been carried out in a very careless and negligent manner without showing the required sensitivity towards the case which involved abduction and sexual assault upon an innocent and illiterate lady."
The court, however, said mere inefficiency or negligence of IO in conducting probe cannot be made a ground to throw out the prosecution case which, otherwise, is established beyond doubt from the deposition of prosecution witnesses.
It also imposed a fine of Rs 40,000 on Singh and said if realised, the amount be given to the victim. He was held guilty for the offences under sections 366 (abduction) and 354B (assault or use of criminal force to woman with intent to disrobe) of the IPC.
According to prosecution, Singh and his associate Jairam had abducted the woman on July 9 this year from near Bijwasan railway station in Southwest Delhi and took her to a room where they tore off her clothes and attempted to rape her.
The victim, a native of Assam, showed courage and pushed them away and ran out of the room, where some people including a woman were present, police said.
The woman asked the victim as to what has happened and gave her clothes to wear and called the police.
During the trial, Singh denied all the incriminating facts and circumstances and claimed false implication.
