Man jailed for 7 yrs for kidnapping and raping minor

Additional Sessions Judge Suresh Chand Rajan sentenced 30-year-old Vijay Kumar, an Uttar Pradesh native on the victim's deposition that he had committed the "wrong act."

"I am of the view that she (victim) had made consistent statements and specifically made allegation against the accused that he had committed the wrong act with her," the judge said, while sentencing the convict and also imposing a fine of Rs 6,000 on him.

The case against Kumar was lodged in May 2010 by the victim's father, a sweetmeat shop owner, who alleged that his employee Kumar has kidnapped his 15-year-old daughter.

Kumar was subsequently arrested on May 15, 2010 by police at Bhatinda in Punjab and the abducted girl too was recovered from him and the two were brought to Delhi.

"Considering each and every facts and circumstances of the case, the victim has assigned the role of accused that he had taken her away to Bhatinda forcibly where accused bought her clothes, bindi, sindoor and even put sindoor in her maang," the court said, while convicting the accused.

"She has also made specific allegation that accused has committed rape upon her three-four times. The prosecutrix is a minor girl of aged about 15 year and 5 months. Her consent is therefore immaterial. So, the prosecution has proved its case without any reasonable doubt against accused Kumar," it said.
