May be constrained to transfer probe if no development shown:

The Madras High Court today said it saw no development in the investigation into the case relating to missing film producer Madhan and observed that if no forward movement is shown before the next hearing, it may be constrained to transfer the probe to an independent agency.
"We see no development in the investigation. It is the last chance for Tamil Nadu Police and if no development is shown before the next date of hearing, we may be constrained to transfer it to an independent agency, which may not be desirable to police," a division bench comprising Justices S Nagamuthu and V Bharathidasan said.
The matter was posted for hearing to August 30.
Madhan of Vendhar Movies was reported 'missing' sinceMay 28, when he left Chennai leaving behind a 'suicide note' stating that he would kill himself in Varanasi.
He reportedly went missing after an alleged failed business transaction with the SRM group.
Madhan had allegedly acknowledged receipt of several crore of rupees from students and parents, promising them MBBS seats in the SRM group of institutions.
On June 6, his mother filed a habeas corpus petition after she suspected foul play in her son's disappearance.
Subsequently, the court had entrusted the probe with regard to alleged receipt of money by Madhan, to Additional Deputy Commissioner of Central Crime Branch, Radhakrishnan.
At the hearing yesterday, the bench had questioned the Investigating Officer (IO) about the whereabouts of Madhan and whether he was alive, to which the IO had submitted that the probe revealed he was very much alive.
"Why Crime Branch in Tamil Nadu is unable to track down film producer Madhan, in spite of lapse of 70 days since it was handed over the case," the bench had said.
The court had asked the IO appointed by it to produce all documents relating to the probe.
The IO was not present in the court today.
When the matter came up for hearing, Public Prosecutor R Rajarathinam submitted that the probe would be expedited and the status report filed on the petition, which drew the comments from the court.
The bench recorded his submission that the IO was hopeful of securing Madhan soon and posted the matter to August 30.
