"So far Lalit Modi has not been found guilty of even the smallest offence. So, he could not have been said to be a defaulter or an absconder," senior party leader and advocate Majeed Memon said.
The party's assertion comes at a time when BJP has backed Rajasthan Chief Minister Vasundhara Raje facing allegations of her alleged links with Modi.
Unfazed by the mounting Congress demand for Raje's resignation, the BJP continued to defend the Chief Minister with its spokesman Sudhanshu Trivedi asserting that there is "no substance" in the rival party's allegations.
