Justices S Manikumar and C T Selvam posted the plea by PFI for hearing to February 24.
Shahul Hameed, President, Popular Front of India, Madurai district, submitted that the single Judge's order was against the constitution wherein freedom of speech and expression were guaranteed.
The rallies and demonstrations without carrying arms could only be regulated and not prohibited, he contended.
The single judge had on December 4, 2015 directed the Director General of Police to send a circular to all his subordinates intimating not to grant permission for holding demonstrations and rallies on December six from 2016.
The judge had in his order said that such a move (banning rallies and demonstrations on December 6) would avoid wastage of public money, time and deployment of forces.
