PIL in HC seeking quota for differently abled persons in jobs

A plea was today filed in Delhi High Court alleging that differently abled persons have not been provided three per cent mandatory quota in government jobs.
The NGO, in its plea before the bench of justices Pradeep Nandrajog and Jayant Nath, sought implementation of earlier directions issued by the High Court and the Supreme Court on providing quota to differently abled, including visually impaired, persons.
All India Confederation of the Blind has challenged the "arbitrariness" of Delhi Subordinate Services Selection Board (DSSSB) in excluding posts of Special Educator and Computer Teacher for Blind and Low Vision in its recent advertisement.
The confederation has alleged that this has been done "despite these posts being identified for the said category of persons by Ministry of Social Justice and Empowerment (MSJE) in Group C in its notification issued on July 29, 2013.
"...It further sets out that no ministry or department shall exclude any identified job/post from the purview of reservation at its own discretion...," the petition said.
The bench, however, adjourned the matter for tomorrow, saying a similar issue is pending before it and it will hear it together and pass the order accordingly.
"Renotify it for tomorrow," the court said.
The apex court had on October 8 last year had also asked the Centre and state governments to provide 3 per cent quota in jobs to disabled persons in their departments, firms and PSUs, observing that it was an "alarming reality" that they are unemployed due to social and practical barriers.
The NGO has also challenged incorrect implementation of 3 per cent reservation for persons with disabilities by DSSSB, which it holds to be in contravention of Section 32 and 33 of the Act in view of failure to make one per cent reservation for blind persons and persons with low vision in the said two identified posts as per the Act.
