A division bench of Justice Shree Narain Shukla and Justice Rajan Roy passed this order on a PIL filed by Hindu Personal Law Board through its president, Ashok Pandey.
The petitioner alleged that deployment of police there was causing inconvenience to devotees as sometimes police personnel throw them out and misbehaved with them, which hurt religious sentiments.
On behalf of the state government, Additional Advocate General Bulbul Godiyal contended that the PIL was not maintainable as the petitioner has no locus to file it.
The court, while providing a week's time to seek instructions to place the state's response in the matter, fixed April 28 as the next date of hearing.
