Road mishap victim's family gets over Rs 36 lakh compensation

The family members of a man, who died in an accident due to rash driving by the driver of car he was travelling in, have been awarded a compensation of over Rs 36 lakh by a Motor Accident Claims Tribunal (MACT) here.
The tribunal directed Future Generali Insurance Company Ltd, with which the offending car was insured, to pay Rs 36,11,700 to the wife, two minor kids and father of 38-year-old victim Ayodhya Singh who died in the accident in November 2012.
"Thus in view of the testimony of prosecution witnesses and documents on record, the negligence of the driver of offending vehicle (car) has been prima facie proved," MACT Presiding Officer Harish Dudani said.
Singh's family members approached the tribunal seeking compensation and submitted that the accident took place on November 28, 2012 when the victim was sitting in the car driven by its offending driver Jay Prakash.
When the car reached near Jhandewalan Metro Station here, it hit a stationary tempo. As a result, Singh sustained injuries and he was taken to Lady Hardinge Medical College where he expired during the course of treatment on November 30, 2012.
A criminal case was also registered against the car driver at Mandir Marg Police Station.
The petition said the accident took place due to the rash and negligent driving of the driver.
Ayodhya Singh was employed as a transporter and was earning Rs 50,000 per month.
The car driver had claimed before the tribunal that he was driving the car at normal speed and the accident took place as the tempo was moving at a high speed and had stopped without giving any indication.
The court, however, rejected his submissions.
