Swamy allowed to implead in PIL on Muslim women's inheritance

The Kerala High Court today permitted BJP leader Subramanian Swamy to implead in a PIL seeking to declare the practise followed by Muslims regarding the inheritance of property by women on basis of Shariat, as 'unconstitutional'.
The petition was filed by Khuran Sunnath Society of Kozhikode and others in 2008.
When the impleading petition came up before a division bench comprising Chief Justice Manjula Chellur and Justice A M Shaffiq, the court allowed the plea and permitted Swamy to participate in the further proceedings of the case.
The petitioners had sought intervention of the court to prevent 'misinterpretation' of Holy Quran and its applicability to the Shariat and forbid the discrimination meted to a major section of Muslim community in India.
The practise among the Sunnis of depriving women of their due share in full was probably on the basis of the assumption that generators of the properties were invariably men.
Now, Muslim women in Kerala were occupying high positions and they generate wealth and property, earned by them and protected like men, the petitioners had submitted.
