Thane Additional Sessions Judge Mrs V V Virkar recently awarded three years' RI to the accused - Mohamad Shabir Shaikh (35) and Sajid Khan (38) - and also slapped a fine of Rs 75,000 each on them while holding them guilty under section 304 Part-II (culpable homicide not amounting to murder) of the Indian Penal Code.
The judge also sentenced both of them to one-month imprisonment along with two other accused - Rubina Shaikh (30), (wife of Mohamamd Shabir Shaikh) and Nazir Shaikh (48) - and fined all the four Rs 5,000 each while convicting them under IPC section 504 (intentional insult with intent to provoke breach of the peace).
Additional public prosecutor Ashok Khamkar told the court that the victim, Javed Ishaq Qureshi (37), who ran a cable TV business, and the four accused were neighbours in Jupiter building on Mira Road here.
They had frequent quarrels as the accused, who lived on the upper floor, used to throw garbage from their apartment which fell and spoilt Javed's house.
During one such fight on May 29, 2005, they severely beat up Javed and and also allegedly attacked his wife.
The victim was admitted to hospital where he succumbed to his injuries a month after the incident.
However, the court, after hearing both the counsels, held Mohamad Shabir Shaikh and Sajid Khan guilty of culpable homicide under section 304-Part II of Indian Penal Code and all the four under section 504 (intentional insult with intent to provoke breach of the peace) of the IPC.
