Hc Rejects Plea For Court Intervention In Cbi Inquiries

The petition was filed by Subhash Shrike, a Marathi journalist, against the director general CBI, joint director (Investigations), CBI, Mumbai, the Union of India through the ministry of home and the former CBI superintendent Y P Singh.

In his petition, Shrike had claimed that from various news reports he gathered that the former CBI SP, Y P Singh was repatriated to Maharashtra Police following his investigations into the scam involving a corporate house, which according to his understanding was Reliance Industries (RIL).

According to the petitioner, Singh had launched investigations into the buying of Rs 945 crore worth of RIL shares by UTI with a five-year lock-in period which had caused the prejudice to the public interest.

According to the petitioner, Singh had recommended launching of a case against RIL which was agreed to by his immediate boss but the Director General had stalled the move by refering the matter to the finance minsitry. This was done in violation of Sections 154 and 157n of the Criminal Procedure Code, the petitioner claimed.

The petitioner claimed that finance minstry did not approve the move and the investigations were allegedly scuttled. Another recommendation involving RIL and Enron as well as the Hira Panna Oil Fields was similarly scuttled, claimed the petitioner.

However, the High Court did not find any substance in the plaint as the matter of Y P Singh's repatriation was already pending before the Central Admnistrative Tribunal (CAT).enter>
