Pvt employers can specify court jurisdiction for job related disputes: SC

The Supreme Court has said private employers can include a clause in appointment letters specifying that any employment-related disputes must be resolved in a particular court or jurisdiction. A bench comprising Justices Dipankar Datta and Manmohan said a contract was a legally binding agreement, regardless of the parties involved or their strengths. "The right to legal adjudication cannot be taken away from any party through contract but can be relegated to a set of courts for the ease of the parties," it said. In the dispute at hand, the court observed, the clause did not take away the right of the employee to pursue a legal claim but only restricted them to pursue the claims before the courts in Mumbai alone. The apex court was hearing appeals filed by two employees of HDFC Bank appointed in Patna and Lord Krishna Bank in Delhi, respectively. EPFO deadline for employers to file wage details extended till Jan 31

Retirement fund body EPFO has extended time till January 31, 2025 for employers to upload wage details etc regarding 3.1 lakh pending applications for pension on higher wages. An online facility was made available by EPFO for submitting applications for validation of options/joint options for pension on higher wages, a labour ministry statement said. The facility was for eligible pensioners or members in compliance with the Supreme Court order on November 4, 2022. It was launched on February 26, 2023 and was to remain available only till May 3, 2023. However, considering representations of employees, the time was extended to June 26, 2023 in order to provide complete four months to eligible pensioners/members for filing applications. A last opportunity of 15 days was further given to remove any difficulty faced by them. Accordingly, the last date for submission of applications was extended to July 11, 2023 and a total of 17.49 lakh applications were received from pensioners/membe

Employers up 6.6% at 766,000; members rise 7.6% in FY24: EPFO report

Retirement fund body EPFO has seen a 6.6 per cent year-on-year rise in contributing employers to 7.66 lakh while recording 7.6 per cent growth in members to 7.37 crore in 2023-24, a labour ministry statement stated. According to a statement issued on Sunday, the labour secretary and Chairperson of the Executive Committee, Central Board, Employees' Provident Fund Organization (EPFO), presided over the 109th Meeting of the Executive Committee on November 8, 2024, at EPFO Head Office in the national capital. This was the first meeting of the Executive Committee after the re-constitution of the panel on September 27, 2024. The Executive Committee is a statutory panel under the EPF Act 1952, with the mandate of rendering assistance to the Central Board of Trustees, EPFO in the discharge of its functions. HC stays order declaring Ola's relation with drivers as employer-employee

The Karnataka High Court has stayed a single judge verdict, which had classified the relationship between ANI Technologies Private Limited (Ola) and its drivers as that of employer-employee. The original ruling required Ola to address complaints of sexual harassment involving its drivers. The interim order that stayed the original judgment was passed by a vacation bench consisting of Justice S R Krishna Kumar and Justice M G Uma, following an appeal by Ola against the earlier judgment dated September 30. In the original order, the single judge had directed Ola and its Internal Complaints Committee (ICC) to pay a compensation of Rs 5 lakh, along with Rs 50,000 in legal costs, to a woman who had filed a complaint of sexual harassment against an Ola driver. Indian employers most bullish globally on Oct-Dec quarter hiring: Survey

Corporate India reported the strongest hiring sentiments globally for the next three months, with 37 per cent of employers planning to increase their staff strength as businesses are bullish about the country's economic position, a survey said on Tuesday. According to the ManpowerGroup Employment Outlook Survey Q4, 2024, of nearly 3,150 employers across sectors and regions, the Net Employment Outlook in India is the strongest worldwide at 37 per cent, followed by Costa Rica (36 per cent) and the US (34 per cent) in the second and third place respectively. The Net Employment Outlook (NEO) is calculated by subtracting the percentage of employers who anticipate reductions to staffing levels from those who plan to hire. A significant percentage of employers in India are taking active measures to promote diversity and gender parity through progressive policies, upskilling, and flexibility and have realigned their hiring strategies by mandating women hiring at every level across sectors, says a report. Becoming a mother is a natural phenomenon, and an employer has to be considerate and sympathetic towards women staffers, the Bombay High Court said on Friday, while quashing a communication issued by the Airport Authority of India (AAI) denying maternity leave to an employee on the ground that she already had two children. EPFO extends deadline till May 31 for employers to upload pension details

Retirement fund manager EPFO has extended the deadline till May 31 for employers to upload wage details of those opting for higher pension to its database. Earlier, the deadline for employers to upload wage details for those opting for higher pension on higher contribution was December 31, 2023, a labour ministry statement said. EPFO (Employees' Provident Fund Organisation) had earlier provided all its subscribers an online facility for submitting applications for validation of option/joint options for pension on higher contributions. The higher pension option was offered to eligible pensioners/EPFO members in compliance with the Supreme Court order dated November 4, 2022. The online application facility was launched on February 26, 2023 with an initial deadline of May 3, 2023.
