Independence of regulators and overlapping of functions with Competition Commission of India in sectors like telecom are some of the issues that need to be addressed for setting up a healthy regulatory environment.
 
"Even though we have regulators in telecom and power, India has been unable to adequately address the issue of independence satisfactorily," Montek Singh Ahluwalia, Deputy Chairman, Planning Commission said at a seminar on regulatory issues organised by CII.
 
Ahluwalia added that setting up a regulator, however, was not a precondition for successful private participation. For instance, the regulator in the power sector could not replicate the success of Trai.
 
But he also said that with the quantum of investment in infrastructure envisaged, a fair regulatory mechanism was one way of attracting private players.
 
In telecom, issues raised by participants in the seminar were that with the sector maturing in terms of attracting private players, competition related issues would now become important.
 
In this context, there was lack of clarity on whether that these issues would be handled by the Competition Commission of India or the existing regulator.
 
Power Secretary R V Shahi, while favouring setting up of regulators for coal and gas sectors, emphasised the need to continue with regulatory mechanism in the power sector as there still existed a demand supply gap favouring the sellers.
