NHRC recommends Rs. 5 lakh in a case of police torture in UP

The National Human Rights Commission (NHRC) has recommended that the Uttar Pradesh Government pay Rs. five lakh to a victim of police torture due to which he became permanently disabled.

The case is related to a student named Ashish Kumar Madheshiya, who as a 17-year-old boy, was picked up by the police personnel of Pipraich Police Station, Gorakhpur district, on 23rd January, 2010.

During the course of inquiry, the NHRC found that Ashish was illegally detained and severely tortured by the Station Officer (SO) and two Constables, which caused serious injury to his spine making him permanently crippled. As a result, the boy could not walk in his lifetime without help from others.

The NHRC has observed that this is a case of grave violation of human rights committed by the police officials for which the state is liable and recommended monetary relief. The NHRC has also asked the Senior Superintendent of Police (SSP) of Gorakhpur to respond within four weeks with the status of the departmental action and chargesheet against the erring police officials in the court.

The state government, through its Chief Secretary, has been given six weeks time to submit proof of payment to the victim.
