Senior IPS officer Amitabh Thakur's suspension ended on October 11, 2015, as it was not extended before the mandatory 90-day period, an affidavit by the ministry of home affairs before the Lucknow bench of the Allahabad High Court said.
Thakur was suspended by the Uttar Pradesh government after he filed a police complaint, along with a recording of a telephonic conversation, against Samajwadi Party chief Mulayam Singh Yadav for allegedly threatening him with physical harm.
The IPS officer submitted a copy of this affidavit to the state home department on Wednesday and sought issuance of the formal orders for his reinstatement.
The ministry of home affairs has quashed Thakur's suspension order with effect from October 11, 2015, an affidavit filed by the MHA Under Secretary Mukesh Sawhney in the court said.
The central government's stand was made known in a contempt petition filed by the IPS officer against Union Home Secretary Rajiv Mehrishi before the Lucknow bench of the Allahabad High Court after his suspension from service was extended after the mandatory 90-day period.
Sawhney's affidavit said that as per section 3(8)(a) of the All India Services (Discipline and Appeal) Rules, Thakur's suspension ended on October 11 last year because it was not extended before 90 days, adding that a letter dated March 31, 2016, had been sent to the state government in this regard.
