Chinese company's suit against MH370 passenger dismissed

A Beijing court has dismissed an appeal from a Chinese real estate company against a man who was travelling on the still missing Malaysia Airlines Flight MH370 because the passenger is yet untraced.

The passenger, surnamed Li, had entered into a contract with the real estate company on Nov 7, 2012, to buy an apartment in Beijing's Tongzhou district, China.org reported.

At the time of the purchase, the apartment price was 2.7 million yuan ($425,790) and its down payment was 818,255 yuan, according to a statement by the Beijing Tongzhou District People's Court.

On March 8, 2014, flight MH370 -- enroute from Kuala Lumpur to Beijing -- disappeared off the radars.

Later, a bank where Li failed to meet the apartment's loan requirements, forced the real estate company to pay, which was why the company was suing Li.

The judge adjudicating the case advised the real estate company to come to an understanding on the issue since Li was still missing and dismissed the lawsuit.

"Where the flight is and what condition Li is in is still uncertain, which causes Li's legal status to be pending. In this way, it's not suitable to make a lawsuit," the court said, adding it has dismissed the appeal under the Civil Procedure Law.

No trace of the flight with 239 people onboard has been found till date.
