The Supreme Court on Friday will hear the Bihar government's petition challenging the grant of bail to Raj Vallabh Prasad Yadav, accused of raping a minor in February 2016. The state assembly member has been suspended from the ruling RJD.
A bench of Justice Anil R. Dave and Justice L. Nageswara Rao agreed to hear the Bihar government's plea after counsel Gopal Singh told the apex court that the Patna High Court granted bail even though the trial in the case is going on and the victim is yet to depose.
Gopal Singh told the bench that the bail was granted to the RJD lawmaker, now suspended from the party, glossing over the reasons advanced by the high court rejecting the bail earlier.
